General Conditions of Sale

    The sale of products on is governed by these “General Conditions of Sale”, comprising the articles presented below. 
1.   The parties.
1.1   Monnalisa SpA, hereinafter the “Seller”, carries on "e-commerce" activities via its on-line shop at, hereinafter the e-commerce site, which sells directly to the “End Consumer”.
1.2   “End Consumer”: any adult person who purchases goods from the above website for non-commercial, resale and/or rental purposes.
1.3   The Seller may make changes or amendments to these “General Conditions of Sale” at any time. Accordingly, customers will be requested to accept the “General Conditions of Sale” at the time of each purchase.
1.4   The End Consumer, hereinafter the "Customer", is requested to read carefully the “General Conditions of Sale” accessible via the links placed on, as well as the e-mail sent to the Customer's e-mail address following the “order confirmation” submitted on completion of the purchasing process.            
2.   Purchasing
2.1   Product sheet: each product is presented by a photograph and an accompanying “Product sheet” that contains: a)      Synthetic Description. b)      Colours and sizes available, or potentially available, for purchase. c)      Price d)     General Description e)      Theme Info f)       Review.
2.1.1     General description: this is a brief description of some of the product's characteristics. The description may includes references that are not real or which, in any case, do not relate directly to the product. The composition of the products presented for sale, i.e. the percentages of each material comprising their fabrics, is stated on their labels.
2.1.2   Colours and sizes: the availability of colours and sizes is stated merely for descriptive purposes. The screen colours of the products indicated as available might not match their true colours due to technical reasons, such as the resolution of the Customer's screen, difficulty of reproduction as a consequence of the materials comprising the products etc.
2.1.3   Price: the price stated on the product sheet and in the “catalogue”, is the selling price to the public including VAT, but excluding transport costs and any customs duties and charges applicable in the country where the Customer is resident, and/or in the country of destination of the goods. Monnalisa SpA reserves the right to change the prices at any time without notice. Customers will be charged the prices applying at the time of the “Order confirmation”.
2.1.4     Photograph: although presented with care, a photograph might not be an exact representation of the product. Accordingly, Monnalisa SpA is not responsible for any inadequacies in the graphic representation of the products shown on the e-commerce site. The photograph must just be considered as an example. Just one colour variation of each product potentially available for sale will be photographed.
2.1.5   Review: this is a special area where the End Customer has the opportunity to report his personal experience regarding a product sharing datas about quality, wearability…giving a qualitative judgment but also a quantity one by votes.
2.2   Product selection and addition to shopping basket: a product is selected by choosing its colour and size and then clicking the “Add to Cart” button. The “Basket” may contain one or more products and may be changed at any time prior to the “Order confirmation”. Products may be added to the basket both from the catalogue and from the product sheet.
2.3   Order confirmation: the order may be confirmed after acceptance of the “General Conditions of Sale” and input of the information needed for registration of the order and shipment of the goods listed in the “Order confirmation”, being the list of products contained in the basket inclusive of shipping costs.
2.4   Methods of payment: before acceptance of the order, the Customer must select one of the following methods of payment available on the e-commerce site: a) Credit card. b) Pay Pal. c) Bank transfer. d) Cash on delivery. a)      Credit card: if the credit card option is selected, the related financial information (e.g. number of the credit/debit card, expiry date etc.) will be sent in encrypted form to Banca Sella or other banks that provide electronic payment services. Such information will never be used by the Seller except to complete the procedures relating to the Customer's purchase, make reimbursements if products are returned on exercise of the Customer's right of withdrawal, prevent e-commerce fraud or report it to the police. b)      Pay Pal: if the Pay Pal option is selected, the Customer must follow the procedures described on the Pay Pal website. c)      Bank transfer: if the bank transfer option is selected, the Customer must make a transfer to the bank account details presented on the e-commerce site. Payment is confirmed when the amount transferred is credited to the Seller's bank current account. The Seller reserves the right to accept the bank transfer slip as proof of payment when received by e-mail at the address d)     Cash on delivery: if the cash on delivery option is selected, the Customer will pay on cash the amount of the order upon receipt of the goods. In the event of failure to pay, the goods will not be given to the Customer.
2.5   Acceptance of order: the Seller reserves the right to refuse the order if the Customer does not comply with the purchasing procedure, does not accept the General Conditions of Sale or does not provide all the data needed for shipment and invoicing, or if payment is not received because, in the case of Credit Card payment, the bank did not authorise the charge to the Customer's credit card; in the case of a bank transfer, the amount was not credited to the Seller's bank current account within three (3) working days of the issue date of the order confirmation; in the case of  Pay Pal payment, the amount was not credited correctly to the Seller's account. The total amount comprises the total of the selling prices and the transport costs, depending on the method of delivery selected by the Customer and/or available on the e-commerce site. Customs duties costs are excluded. If the “Cash on delivery” payment method is selected, the goods will be sent before receipt of payment. If a Customer refuses cash-on-delivery goods on two consecutive occasions, the next order from that Customer will be rejected. The Seller may refuse an order if there is any dispute between Monnalisa SpA and the Customer, or for any other legitimate reason.
2.6   Acceptance of order: the Customer accepts its order by sending the Order confirmation referred to in article 2.3 to the Seller in electronic form. The Order confirmation is proof of acceptance of the order by the Customer, including these General Conditions of Sale.
2.8   The Order confirmation will be retained in the Seller's database for the period of time necessary to complete the order and, in any case, for the time required by law.
2.9   The language available for making contracts with the Seller is Italian.
3   Registration of order and availability of products.
3.1   Once the contract is made, MONNALISA SPA will register the Customer's purchase order.

Availability of products: if the products presented on the e-commerce site are no longer available or on sale at the time of the last visit to the e-commerce site or on submitting the order confirmation, the Seller will inform the Customer about the non-availability of the products ordered on a timely basis and, in all cases, within (30) days of the day following transmission of the Customer's order to the Seller. If the order has been confirmed and the price paid, the Seller will reimburse the amount advanced by the Customer.
3.3   By submitting the Order confirmation, the Customer confirms acceptance of the General Conditions of Sale and the additional information presented on
3.4   Upon making the contract, the Seller will send a purchase order receipt to the Customer by e-mail, containing a summary of the information included in the order confirmation (General Conditions of Sale, Information about the right of withdrawal, information about the key characteristics of the product and details of the price, payment method and delivery costs).
4.   Sample Sale: this is the new section where the Customer can find out sample items used for fashion shows, shooting and sale campaigns a very interesting prices. Sizes and colours are limited according the collections.

5.   Product warranties.
5.1   All products carry an identification tag. The Customer must not remove the tags from the products purchased, since they are an integral part of them.
5.2   If the Customer exercises its right of withdrawal, the Seller has the right to refuse the return of any products not carrying the related tags, or whose essential and qualitative characteristics have been altered, or which have been damaged.
6.   Customer support
6.1   The Customer may request any information needed from the Seller's support services by sending an e-mail addressed to 
7.   Right of withdrawal
7.1   The Customer has the right to withdraw from the contract made with the Seller, without penalty and without giving any reason, within ten (10) working days from the date of receipt of the products purchased on the e-commerce site. It is not possible to exchange an item selected for another. As an exception, the Seller may decide to accept exchanges requested by the Customer.
7.2   In order to withdraw from the contract, the Customer must use the return form and follow the instructions presented in the “Returns” section of the e-commerce site and in points 6.1, 6.2, 6.3 and 6.4 of these “General Conditions of Sale”.
7.3   The only costs that the Customer must bear are those for returning the products acquired if the carrier selected is different to that specified by the Seller on the Return form. If the Customer decides to use the carrier specified by the Seller, the cost of returning the products will be borne by the Seller.
7.4   Right of Withdrawal - in addition to compliance with the terms and conditions described in points 6.1, 6.2 and 6.3 above - the right of withdrawal is exercised properly if all the following conditions are met:
  1. the Return form must be properly completed and sent to the Seller within ten (10) working days of receipt of the products;
  2. the products must not have been used, worn, washed or damaged;
  3. the identification tags must still be attached to the products;
  4. the products must be returned in their original packaging;
  5. the products returned must be sent to the Seller in just one shipment;
  1. the products returned must be given to the carrier within ten (10) working days of the date on which the Customer received the products.
7.5   If the Right of Withdrawal is exercised in accordance with the terms and conditions specified in this article 6, the Seller will reimburse any amounts already collected for the purchase of the products.
7.6   The amounts will be repaid to the Customer in the shortest possible time and, in any case, within thirty (30) days of the date on which the Seller becomes aware that the Customer has exercised its right of withdrawal. As indicated in article 8, the Seller will activate the repayment procedures after checking compliance with the above-mentioned terms and conditions.
7.7   In the event of failure to comply with the terms and conditions specified in this article for exercising the right of withdrawal, the Customer will not be entitled to reimbursement of the amounts already paid to the Seller or to issue of the credit note requested; however, at its expense, the Customer may obtain the return of the products in the state in which they were sent to the Seller. Failing this, the Seller may retain both the products and the amounts already paid for their purchase.
8.   Shipments
8.1   Shipment times: shipment times do not depend on Monnalisa SpA, but on the shipment method selected by the Customer when making the Order and on the carrier used to send the goods acquired. Delivery generally takes place within three (3) working days in Italy, within seven (7) days outside of Italy and within two-three (2-3) weeks in Russian Federation (EMS courier). These times may be affected by unexpected events and the time needed for customs clearance. The Seller is not responsible under any circumstances for actual delivery times that differ from those indicated, although it will do everything possible to ensure compliance. In case of product available in one our shops the system will show the symbol Available in shop and the shipment could take more days due to the product is outside the principal warehouse.
8.2   Shipping costs: shipping costs are borne by the Customer and are included in the amount stated as payable to the Seller in the order confirmation. The shipping costs specified in the order confirmation depend on a number of factors, including weight and volume. commits shipments to UPS courier, except for Russian Federation. Goods shipped to Russia will not be subject to customs duties if the value of the invoice will not exceed the sum of 1000,00 €. In case of the invoice will exceed  this sum EMS will require a customs duty to the client.
9.   Timing and method of reimbursement
9.1   Following the return of products, the Seller will carry out the checks necessary to determine that they were returned properly. If these checks provide positive confirmation, the Seller will send the Customer an e-mail confirming acceptance of the returned products.
9.2   Whatever the payment method used by the Customer, the Seller will make the repayment as quickly as possible and, in all cases, within thirty (30) days of the date on which the Seller becomes aware that the Customer has exercised its right of withdrawal, subject to checking that this right was exercised properly and to acceptance of the returned products.
9.3   If the recipient of the products specified on the order form is different to the party that paid the amounts due for their purchase, the Seller will make all reimbursements due on exercise of the right of withdrawal solely to the party that made the payment..
10.   Disputes
10.1   These General Conditions of Sale are governed by Italian law and will be interpreted under them. These laws include Decree 206 dated 6 September 2005 (Consumer Code), with particular reference to Volume III [of Part III], Chapter I, Section II of the Consumer Code, as well as Decree 70 dated 9 April 2003 (e-commercial regulations), without prejudice to any different obligatory regulations in force in the Customer's country of residence.
10.2   The Court of Arezzo has jurisdiction in the event of disputes.
10.3   Monnalisa SpA reserves the right to make changes or amendments to these “General Conditions of Sale” and to the Privacy Policy at any time. Such changes and amendments will only be effective in relation to purchase orders presented after the change or amendment has been made.
